I am writing in response to your e-mail of the 15th April 2010 and your request for an
internal review of our response to your Freedom of Information (FoI) request
concerning cautions under the Regulation of Investigatory Powers Act 2000 (RIPA)
I have now completed the review. I have examined all the relevant papers regarding
the handling of your request, and consulted the policy unit which provided the original
response. I have also considered whether the correct procedures were followed and
assessed the reasons behind the original response. I confirm that I was not involved
in the initial handling of your request.
My findings are set out in the attached report but, in summary, I can confirm that the
Home Office does not hold the information you have requested and, therefore, the
original decision is upheld.
As discussed in the attached report, I can also confirm that the Home Office does not
hold the data on the Police National Computer (PNC) database and, as such, that
data is not held for the purposes of requests made under the Freedom of Information
Act. The information you have requested wil be held by the relevant individual police
forces in England and Wales. You may wish to make separate requests under this
Act directly to these forces. Information on how to submit an FoI request to each
force can be found on that force’s website.
This completes the internal review process by the Home Office. If you remain
dissatisfied with the response to your FoI request, you have the right of complaint to
