We refer to your requests dated 15 September 2008, in which you ask:
How many reports have have been produced by Planning Decisions Division (PDD) with reference to the Caltongate Development proposals, submitted to the City of Edinburgh Coucnil (CEC) by developers Mountgrange.
When was CEC advised that there was an omission in their planning procedures relating to these applications, and where can the information submitted relating to this, and other reports relating to the Caltongate proposals be viewed.
We have dealt with your request in terms of the Freedom of Information (Scotland) Act 2002 (FOISA) and Environmental Information (Scotland) Regulations 2004.
In relation to your first request, we have written 3 reports in relation to the Caltongate proposal and copies of these can be found at http://www.scotland.gov.uk/Topics/Built-Environment/planning/publications/foi/FOI-Caltongate.
During a telephone conversation on 25 July 2008, with myself, CEC advised the Scottish Government of its omission of the procedure followed when processing the Caltongate development application. Subsequently I wrote to CEC, on 1 August 2008, to inform it that as there had not been full compliance with the terms of the Town and Country Planning (Notificaiton of Applications)(Scotland) Direction 2007, these applications could not be considered to have been notifed. The letter went on to request that further consultation should be carried out and, if CEC were still minded to grant, the applications should then be notified to Scottish Ministers for their consideration. Your request should explain why you wish a review to be carried out, and should be made within 40 working days of receipt of this letter, and we will reply within 20 working days of receipt. If you are not satisfied with the result of the review, you then have the right to make a formal complaint to the Scottish Information Commissioner.
