Your complaint of 30th April 2010 has been referred to me under the Council’s Freedom of 
Information Act 2000 – Complaints Procedure.   
 
I would like to offer a full apology for the delay in responding to your original request dated 
1st March 2010 to which, under the statutory framework, you should have received a 
response by Monday 29th March 2010 rather than Thursday 29th April 2010.  I will ensure 
that this matter is brought to the immediate attention of the Freedom of Information 
Officer’s line manager.  You should also know that I am aware of the complaint that you 
made to the Information Commissioner’s Office which was referred to the Council on 27th 
April 2010. The Information Commissioner’s Office gave the Council 10 working days in 
which to respond to the complaint and I am pleased to say that we were able to respond to 
that instruction within 2 working days. 
 
You have also asked for an internal review in relation to our decision not to provide the 5 
year data requested.

I have considered this point carefully and can confirm that the Council does not hold the 
information that you have requested and, therefore, it is not possible to communicate this 
information to you and the Council is under no duty to do so. This is briefly but clearly 
explained by Mr Ingle in his email of 29th April 2010 and is not a decision that in my view 
should be overturned. Therefore, for the reasons stated, I do not uphold your complaint in 
respect of the 5 year data requested. 
 
If you take the view that I have made any mistakes in law and/or fact in considering your 
complaint then you have a further right of appeal which you may exercise by writing to the 
Information Commissioner at the Information Commissioner’s Office, Wycliffe House, 
Water Lane, Wilmslow, Cheshire, SK9 5AF.
