Dear Mr Shaw,

FREEDOM OF INFORMATION APPLICATION REFERENCE NO: 2345/10

Thank you for your request for information received by Lancashire Constabulary on the 23^rd February 2010, which was as follows:-

Could you furnish me with details of all complaints received by you in relation to St Anne's Cricket Club, Vernon Road, Lytham St Anne's, Lancashire, FY8 2RQ as far back as the FOI Act and records allow and to include paper based and computer held records.

Your request has now been considered and Lancashire Constabulary neither confirms nor denies that it holds any of the information requested. This letter serves to act as a refusal notice for your request, as per S.17 (1) of the Freedom of Information Act 2000, by virtue of the listed exemption S.40 (5), Personal Information.

This is because your request refers to one specific location, and as such the confirmation or denial of the existence of any such information, and the disclosure of any such information, could lead to individuals being identified as those who have made complaints to the police or who have been the subject of complaints. This would be in breach of the first principle of data protection, that information held about an individual should be fairly and lawfully processed. This breach would be because identifying those who have made complaints to the police could potentially risk harm coming to the individual, and details of complaints made about any individual constitutes sensitive personal data.

If you are unhappy with the service you have received in relation to your request and wish to make a complaint or request an internal review of our decision, you should write to the Data Protection and Information Officer, Corporate Support and Information Services - Data Protection, Police Headquarters, Saunders Lane, Hutton, Preston PR4 5SB or alternatively send an email to [Lancashire Constabulary request email]. If you are not content with the outcome of your complaint, you may apply directly to the Information Commissioner for a decision.
