Freedom of Information request 93212
I write in reference to your recent request made under the Freedom of Information Act 2000 (FOIA) in which you requested the following information:
It has come to my attention that the council passed a motion to exclude the press and public from Part II of the Executive Board meeting on Friday 12 February 2010 regarding the 2010 Arts & Culture Investment Programme by virtue of Schedule 12A of the Local Government Act 1972. Appendices 1, 2 and 4 are available at this page here:
But Appendix 3 (Schedule of Funding Awards) is missing, owing to prior arrangement (to prevent its routine publication) and following a resolution passed in Item 159 by the Board. As I have observed earlier, Schedule 12A of the Local Government Act 1972 does not include the Freedom of Information Act 2000.
Under the Freedom of Information Act, please could you send me:
Information identifying who made the order to restrict publication of Appendix 3 prior to the Executive Board meeting, why it was made, and under what authority publication was restricted.
The decision to restrict publication was made by the Executive Board and approved by the Leader of Liverpool City Council, Deputy Leader, Executive Member for Enterprise & Tourism and relevant Executive Directors. This decision to restrict publication was based upon the fact that the item was submitted to the Board with a recommendation that given it contained financial information which had yet to be made available to those organisations concerned the report or part thereof should at that stage be considered exempt from publication. This decision was made in accordance with Schedule 12A of the Local Government Act 1972 as amended, which states: information in whole or part may be classed as exempt from publication if the information contained within falls within one of a series of exemptions as set out in the Schedule.
A copy of the missing Appendix 3 of this item.
