Thank you for your email of 26th April 2008 where you requested information about documentation relation to JCPC Appeal 74 of 1997.
I can confirm that the Department holds this information. This information you have requested is exempt under section 32 (Court Records) of the Freedom of Information Act.
I confirm that Section 32 (1) the Freedom of Information Act 2000 exempts information in respect of any court record that may be held. Section 32 (1) states that information is exempt if it is held only by virtue of being contained in documents that have been filed with, or has otherwise been placed in the custody of the court for the purpose of court proceedings; and those that have been created by a court or a member of the administrative staff for the purpose of such proceedings. It is clear that Section 32 (1) applies to the information that you have requested, which is an absolute exemption.
If you are dissatisfied with the handling of your request, you have the right to ask for an internal review. You should submit an internal review request within two months of the date of receipt of the response to your original letter and you should address it to: Access Rights Unit, Selborne House, Point 6.17, 54 Victoria Street, London SW1P 6QT
