FREEDOM OF INFORMATION ACT 2000 - REQUEST 10016 
 
Dear Mr Jenkinson 
Thank you for your request for information on any university submissions to the 
Independent Review of Higher Education Funding and Student Finance, which we 
received on 3 February 2010. 
I can confirm that the University College London holds the information you are 
seeking.  The information is being withheld under Section 22(1) of the Act.  This 
provides that: 
Information is exempt information if—  
(a) the information is held by the public authority with a view to its publication, by the 
authority or any other person, at some future date (whether determined or not), 
(b) the information was already held with a view to such publication at the time when the 
request for information was made, and 
(c) it is reasonable in all the circumstances that the information should be withheld from 
disclosure until the date referred to in paragraph (a). 
As Section 22 is a qualified exemption we are required to conduct a public interest 
test. 
Disclosure of the information may be in the public interest in that it can encourage 
public discussion about the subject under review.  However, early disclosure would 
interfere with the process laid out in the Review Panel’s Operating Protocol - 
http://hereview.independent.gov.uk/hereview/wp-
content/uploads/panel_operating_protocol_nov09.pdf
 - which states that evidence 
will be published as it is received. 
It is important that the body which invited evidence should be allowed to consider 
and debate the issue away from public scrutiny until it is ready to publish it.  This 
point is of particular significance as a second call for evidence has yet to be issued. 
It is therefore reasonable in all the circumstances that the information is withheld until 
it is published by the Review.
