Procedure To Be Followed At Local Hearing Of Appeals Against Pay Grading

1.  BEFORE THE MEETING 
a)  Appeals shall be heard by an Appeals Panel of one officers with delegated powers to act and one Union Representative
b)  Meetings will be called and serviced by the Head of Legal and Democratic Services, or his/her nominee. 
c)  The Head of Human Resources, or his/her nominee, will act as Advisor to the Panel. 
d)  The appellant will be allowed to be represented by his/her trade union representative or fellow worker. He/she will be able to call witnesses and produce documents relevant to his/her defence at the hearing. 
e)   Two weeks prior to the Appeal Hearing Form -------- should be completed stating the claimants case together with any other documentation to be used at the hearing should be submitted to the Head of Legal and Democratic Services by both the appellant and the Council's representative. These will be issued to the Appeals Panel members one week before the hearing. The members will receive the documentation submitted by the required date. Any documents supplied after the date may, or may not be considered by members on the day of the hearing only. 
f)   The Appeal will take the form of a full re-hearing.  

2.   PROCEDURE AT THE MEETING 

2.1   a)  The Council's representative will put the case, in the presence of the appellant and his/her representative, and may call witnesses. 
b)  The appellant or representative will have the opportunity to ask questions of the Council's representative on the evidence given by him/her and any witnesses whom he/she may call. 
c)   The members of the Panel will have the opportunity to ask questions of the Council's representative and any witnesses he/she has called. 

2.2  a)   The appellant or representative will put his case in the presence of the Council's representative and will call such witnesses as he/she wishes. 
b)  The Council's representative will have the opportunity to ask questions of the appellant and any witnesses he/she has called. 
c)   The members of the Panel will have the opportunity to ask questions of the appellant and any witnesses he/she has called. 

2.3  a)   The Council's representative will have the opportunity to summarise his/her case, if he/she so wishes. 
b)  The appellant or representative will have the opportunity to summarise his/her case, if he/she so wishes. 

2.4   The Council's representative and the appellant and representative and witnesses will withdraw. 

2.5   The Panel, with the Advisor, will deliberate in private, only recalling the two parties to clear points of uncertainty on evidence already given. If recall is necessary, both parties will return even if only one is concerned with the point giving rise to doubt. 

2.6   The decision will be announced verbally at the conclusion of the meeting by the Chair of the Panel. 

3.   AFTER THE MEETING 

3.1   The decision, as announced by the Chair, together with reasons, will be confirmed in writing to the appellant and the employing Service by the Head of Human Resources within four weeks of the meeting.
