Freedom of Information Request: 024/2010
Thank you for your request received by the Council 26 January 2010.
In relation to your enquiry, please find the Council’s response set out in italics below:
“Could you please provide by email if possible, entries on the voters register for the
last 5 years for the address 6 St Lukes Cottages London Road Swanley BR8”
The registration of electors is governed by the Representation of the People Act
1983 as amended under Section 8 of the Act, the Council must appoint an officer of
the Council to be the Registration Officer for any constituency or part of a
constituency coterminous with or situated in the Council’s area. The appointed officer
for the registration area of Sevenoaks is the Chief Executive. This appointment is
separate to the appointment as Chief Executive and, although appointed by the
Council, the Electoral Registration Officer’s responsibilities and duties are personal.
An example of this is that the register of electors is deemed to be the property of the
Electoral Registration Officer, not the local authority.
The Electoral Registration Officer does not carry out the duties on behalf of the local
authority but in his own personal capacity. A list of public bodies and local authorities
that are subject to the provisions of the Freedom of Information Act is available at the

As you will see, the Freedom of Information Act does not list any person appointed
under the Representation of the People Act 1983. It follows that the Electoral
Registration Officer, Returning Officer or any other person appointed under the Act
are not subject to the provisions of the Freedom of Information Act.
Notwithstanding that there is no statutory obligation to provide this information, I
respond below to your enquiries below.
The current register of electors is available for inspection (under supervision) at the
main Council Offices, Argyle Road, Sevenoaks and at the local office in St. Mary's
Road, Swanley.
Once the register is superseded each 1st December, more than 10 years has to
expire from the date of publication of the register before it is again available for
inspection (under supervision) in accordance with regulation 109A(9) of the
Representation of the People Regulations 2001. Past copies of the register can be
inspected at the Sevenoaks Library, Buckhurst Lane, Sevenoaks by appointment on
01732 453118/452384/450305, at the Centre for Kentish Studies, Sessions House,
County Hall, Maidstone, 01622 694472 or 01622 694452 and also at the British
Library (Social Policy Information Service), 96 Euston Road, London, NW1 2DB,
