Request under the Freedom of Information (Scotland) Act 2002
I refer to your request dated 20 January 2010 requesting that the following information be provided to you:
All risk assessments carried out on the advertising board erected upon the pavement adjacent to 338 Gallowgate. In particular, those risk assessments that consider the impact upon the visibility of cars joining Gallowgate from Bain Street.
I can confirm that the Council holds the information that you are requesting. The Council is treating your request as a request under the Freedom of Information (Scotland) Act 2002.
However, on inspecting our records and the information which we hold, it would appear that all of the information requested is covered by an exemption or exemptions contained within the Act. We are required to explain why we believe this to be the case.
The information which you have requested is, in our opinion, exempt from a request under section 1 of the Freedom of Information (Scotland) Act 2002 because of the exemption contained in section 25(1) of the Act. In other words, the information you are looking for is “reasonably accessible” to you without having to make a formal section 1 request.
Specifically, the information is publicly available as it forms part of the relevant planning application 08/01415/DC “Site of Free Standing Advertising Unit Outside 318-320 Gallowgate Glasgow - Display of free standing internally illuminated advertising unit”. As part of the planning application process, Transport Planning was consulted and recommended the Grant of the Planning Application. The consultation response, together with the officer's report form part of the Planning Application, which is already in the public domain and may be viewed at Reception, Development and Regeneration Services, 229, George Street, Glasgow G1 1QU.
If you are dissatisfied with the way Glasgow City Council has dealt with your request you are entitled to require the Council to review its decision. Please note that for a review to take place you must:
Lodge a written requirement for a review within 40 working days of the date of this letter
Include a correspondence address and a description of the original request and the reason why you are dissatisfied

You will receive notice of the results of the review within 20 working days of receipt of your request. The notice will state the decision reached by the reviewing officer as well as details of how to appeal to the Scottish Information Commissioner if you are still dissatisfied with the Council's response. You must request an internal review by the Council before a complaint can be directed to the Scottish Information Commissioner.
