Re: Request for Information
I am writing in response to your request for information under the Freedom of Information Act 2000 (`FOIA') which we received on 19 January 2010.
The wording of your request was as follows:
For the 100 most recent FOI requests which the council considers closed, be that because the request was rejected, met, or declared "not held", please provide the following information:
(1) The date the request was received by the council.
(2) The summary subject of the request - in less than 20 words
(3) The date the request was acknowledged.
(4) The date the initial final response was given
(5) The status of this response, ie met, not held, rejected
(6) Whether an Internal Review was requested, and if so the date on
which this was completed and the outcome status
I have compiled an `Excel' spreadsheet containing the information requested above. Please see Attachment 1.
As explained in my email of 2 February 2010, I have not produced a summary of the subject of your request. My view is that summarising requests amounts to the creation of new information and we are not bound to do this under FOIA. I do appreciate that we are under an obligation to provide `advice and assistance' under section 16 of FOIA and I have therefore disclosed the wording of individual requests. You are obviously free to draft a summary of the wording of individual requests if you wish.
“(7) Whether the FOI Request to the council's knowledge was referred to the ICO.”
To the Council's knowledge, none of the last one hundred FOI requests were referred to the ICO.
(8) Whether the ICO issued any guidance or instruction to the council following this referral.

(9) The final outcome after the ICO referral.
