Dear Ms R,
I am writing with reference to your request for information regarding Impartial
Local Policing, dated 19th January, made under section 1(1) of the Freedom of
Information Act.
You asked for the following information:
One Police Officer, one head of a Dept (one Alistair Pettigrew of RBKC) and one
councillor (Maidstone) all have informed me in one way or other that police have a
duty to inform council employees if they are being investigated, that police have a
duty to the council workers to inform them if they are under investigation? That
screams abuse/bias and of leaving abuses wide-open in council office, do you have
any information you could share please, regarding impartiality regarding
investigations into local authority employees, including councillors?
I am writing to advise you that I have established that the information you
requested is not held by the NPIA.
The NPIA are unaware of any such ‘duty’ applied to council employees and do not
publish guidance in this area. If such a duty exists then it may result from local
arrangements between police forces and their relevant local government
organisations. If this is the case you would be advised to contact your local police
force to establish if such local arrangements exist. Alternatively, the ‘duty’ to which
you refer may be contained in Statue Law. UK Statute Law is published by the
Office of Public Sector Information and accessible via the Statute Law web-site at
http://www.statutelaw.gov.uk.
