Thank you for your further e-mail of 20 January about Vehicle Registration and Licensing.
As previously explained, on all our correspondence, your request for information falls within
the Driver and Vehicle Licensing Agency’s (DVLA) day to day business, your request have
all been treated as ‘Business as Usual’. It is therefore, not possible to request a first or second
internal review of DVLAs handling of your request under Freedom of Information (FOI).
You have asked which section of which Act gives the DVLA “enforcement” powers. It is the
Vehicle Excise and Registration Act 1994 Section (6)(1)(2).
I will only re-iterate as also previously explained, DVLA is not responsible for providing
definitive advice and are not in a position to comment further. Only the courts can give a
definitive interpretation of the law. Should you question the legality and definitions of the
Vehicle Excise and Registration Act 1994 (as amended). You may wish to seek independent
legal advice so that you properly understand the fit between your view of your obligations
and the application of statute law requirements to you.
