Thank you for your email of 5 January, in which you ask for the following information from the Ministry of Justice (MOJ):

Your request has been handled under the Freedom of information Act 2000 (FOIA). I can confirm that the Department holds some of the information you are seeking.

The answers to your questions are as follows, I have referred to each question in turn;

  1. The number of people cautioned for a Part 1(interception) offence is provided in the attached document at Table 1.

3, 4 & 5. In 2008, no people were convicted, fined, or given immediate custody for Parts I and III. However, we able to provide you with the number of persons proceeded against at Magistrates' courts for offences under the Regulation of Investigatory Powers Act 2000 (Part III), England and Wales 2008. You will see from Table 2 that of the 4 defendants proceeded against, one was discharged and three were committed for trial to the Crown Court.

6. See points 2, 3, 4, & 5 above for available data for 2008 for Parts II and III of the Act.

Part II deals with “Authorisation of Surveillance & Human Intelligence Services” and I can confirm that the department does not hold this information. You may wish to contact the Home Office as they may hold information regarding this part of the Act. See point 1 above for contact details for the Home Office.

On 22 February you complained about the length of time it was taking to answer your request which I will now consider.

I have thoroughly reviewed the reasons for the delay and I apologise for the way in which your request for information was handled on this occasion.
