FREEDOM OF INFORMATION ACT 2000 - INFORMATION REQUEST

I refer to your request for information about small business rates relief.

You requested the following information:

  1. Addresses and RV's of commercial properties that are within our council up to a RV of £12,000 who are eligible for, but not currently receiving small business rates relief.

  2. The names of the owners of those properties.

I am writing to advise you that I am unable to provide the information you require as I hold no easily accessible reports that can provide this information. I would have to pay a software supplier to write a program to enable recovery of the information.

If I could obtain the information, all those ratepayers would be eligible to apply for small business rates relief but would not necessarily qualify for the relief as other factors have to be taken into account.

Also, if I could have provided the information any actual address owned by an individual is classified as personal information, following the ruling in CP England & LB of Bexley v The Information Commissioner and would be exempt information under Section 40 of the Freedom of Information Act.

In addition, if I were able to provide the details of those not receiving SBRR, those in receipt could be identified and this information is considered to have been provided in confidence and so exempt under Section 41 of the Act.
