RESPONSE |
ADDITIONAL INFORMATION |
Were there any incidents of serious violence in the North Huyton area on 21st Nov 2009 and 22nd Nov 2009 (Incidents of serious violence means whatever a Police Inspector or above would class as serious violence, serious enough to put a Section 60 CJPO Act 1994 order in place)
|
Yes |
Section 60 orders may be authorised in the reasonable anticipation of incidents of serious violence in order to prevent the occurrence. The order can be extended in regard to offences which have, or which are reasonably suspected to have been, committed in connection with any activity falling within the authorisation. (Authorisations may also be made in the belief that persons are carrying dangerous instruments or offensive weapons without good reason).
It should not be assumed that orders are only made in respect of incidents that have happened on the date(s) on which the orders are in force. |
This request is identical to request number 2 made on 22nd November 2009 other than the dates in question. A response was provided to you on 7th December 2009 (our reference No. CW59/09). On the same date you made the same request but in respect of a different period (of 2 days). I would advise you that if a further request is made in respect of the same or substantially similar subject matter within 60 days then consideration will be given as to whether the request is to be treated as vexatious as described in Section 14 of the Act.
