I write in connection with your request for information received by the Norfolk Constabulary on the 
23rd of November 2009, in which you sought access to the following information: 
 
•  How many arrests have been made as a result of racially aggravated offences in each of 
the last five years (2004 to 2009)? 
•  What were the reasons for these arrests and how many arrests were made for each 
offence? 
•  How many of these arrests resulted in convictions in court? 
 
Extent of Searches to Locate Information: 
 
To locate the information relevant to your request, searches were conducted within the Business 
Performance Analysis Unit of the Norfolk Constabulary. 
 
The time taken to identify, locate, and retrieve the information relevant to your request was 4 
hours; all of the information contained in this response has been provided to you free of charge.  
 
At a statutory rate of £25 per hour, as provided for by the Freedom of Information (Appropriate 
Limit and Fees) Regulations 2004, the estimated cost to the Norfolk Constabulary for retrieving the 
information relevant to your request was £100 
 
Result of the Searches to Locate Information Relevant to your Request. 
 
Due to the way in which information is recorded on the Norfolk Constabulary’s custody database, 
our data analysts are unable to provide statistical data relating to arrests for racially aggravated 
offences recorded since January 2004.   
 
The only method of retrieving this data would be to manually review every custody record created 
within the past 6 years for information that refers to a racially motivated offence. 
 
 

 
Research of this magnitude would exceed the appropriate limit for dealing with Freedom of 
Information requests, in terms of costs, and therefore Section 12(1) of the Freedom of Information 
Act applies. 
 
Section 12(1) of the Freedom of Information Act states that a public authority is not obliged to: 
“…comply with a request for information if the authority estimates that the cost 
of complying with the request would exceed the appropriate limit.” 

The Freedom of Information (Appropriate Limit and Fees) Regulations, defines the ‘appropriate 
limit’ for the Norfolk Constabulary as £450, and specifies that this sum equates to 18 hours work at 
a standard rate of £25 per hour. 
 
In accordance with Section 17(5) of the Freedom of Information Act (2000), this letter serves as a 
Refusal Notice for your request. 
 
 
Additional Information 
 
Although we are not able to provide you with the information you have requested relating to 
arrests, we are able to provide some data from our recorded crime database concerning racially 
motivated recorded crimes.
