Dear Mr Shanks,

Thank you for your e-mail dated 20 November 2009 addressed to the Driver and Vehicle Licensing Agency (DVLA). As you have been informed, your request for information has been considered, but does not qualify under the terms of Freedom of Information Act 2000 (FOIA). Consequently, your e-mail has been passed to me for reply, as Head of Customer Service and Compliance.

The Late Licensing Penalty (LLP) has been set at £80.00, reduced to £40.00 if paid within 28 days of the 56-day payment period. There have been no legislative changes in this respect. The LLP becomes payable when the registered keeper is notified, which providing the LLP letter has been correctly addressed and appropriately posted, is considered to be at the time that the letter would be delivered in the normal course of post.

The LLP letter has undergone various changes, with the aim of continually improving and developing our customer service, the last of which occurred on 27 March 2009 when the 5-day postage allowance was added. This amendment was not due to the Interpretations Act, and consequently does not impact on the Agency's Court action.
