Internal review of request under the Freedom of Information Act 2000
|

As the Council's Monitoring Officer, I have now carried out an internal review of your request under the Freedom of Information Act 2000 ("the Act") regarding performance targets.
Findings
My findings in this matter are as follows.
On 20 November 2009 you made a request under the Act for “all details of the performance targets for a CEO as set by the enforcement contractor NSL Service Ltd”. You further stated “these targets are approved by Bolton Council”.
On 22 December 2009 the Council responded to your request, stating that it did not hold the information requested.
On 28 December you asked for an internal review of this response, which was referred to me.
When it receives a request, the Council is obliged under section 1(1) (a) of the Act to inform the requestor whether it holds the information requested. There are some exemptions from this which are not relevant here. The Act only applies to information which is held by a public authority. The term `held' is defined in section 3(2) of the Act.
In this case the Council informed you that it did not hold the information. Having investigated the matter, I am satisfied that the Council does not hold the information you have requested.
Decision
The Council does not hold the information you have requested. It informed you of this and thereby discharged its obligation under section 1(1) (a) of the Act.
