REQUEST FOR REVIEW UNDER THE FREEDOM OF INFORMATION (SCOTLAND) ACT 2002

I refer to your e-mail request dated 7 January 2010 for a formal review on the basis that you did not receive a response to your freedom of information request of 19 November 2009.

Your Request

You submitted the following request for information:

“Could you give me a full list of Council workers who have had Common Purpose training? I would like a full list and I would like to know how much this cost in total, say in the last 5 years. Also, does a percentage of Council tax money go towards paying for the trainees course?”

The Review Decision

I acknowledge that you did not receive a response to your request for information e-mail of 19 November 2009, thereby exceeding the 20 days statutory time limit for a response. This was due to the e-mail which contained your original request being quarantined by Glasgow City Council's IT system. Please accept my apologies for this.

In relation to your request for information, I would advise that Glasgow City Council (“Council”) cannot release a full list of Council workers who have received Common Purpose training in the last 5 years as such disclosure of personal data would be in breach of the principles of the Data Protection Act 1998. I would further advise that this requirement for non-disclosure of personal data means that the Council is unable to release the job titles or the Council departments of those who have received Common Purpose training as the individuals in question are identifiable from the nature of such data. Accordingly, the exemption under Section 38(1) of the 2002 Act applies to this aspect of your request.

I am able to disclose that 4 Council employees have received Common Purpose training in the last 5 years at a total cost of £6000.

With regards to your request as to whether a percentage of Council tax money is used to pay for trainees to attend Common Purpose training, I can confirm that no information is held by the Council in this respect. However, I would advise in terms of the Council's duty to provide advice and assistance in disclosing information that the Council's total expenditure for staff training is allocated for use across a wide range of training providers. This expenditure forms part of its total revenue expenditure which is funded from the allocation of a number of the Council's income sources, including Council tax.

Right of Appeal

If you are not satisfied with this response you have the right to make an application within 6 months of receipt of this letter for a decision by the Scottish Information Commissioner, Kinburn Castle, Doubledykes Road, St Andrews KY16 9DS.
