Under Section 8 of the Freedom of Information Act, I would like to
have the following information concerning the flat I live in this
block.
1. Can you advise me what date Hastings Building Control gave its
consent to change the above commercial residence into private
residence.
2. Was Hastings Building Control aware that there is a large
refrigeration unit outside the now flat 3, 22 St Andrew Square?
3. Who is the owner of that refrigeration unit?
4. How many complaints were made with regards to this refrigeration
unit since Hastings Building Control gave its consent into private
residence?
5. Can you forward to me a copy of the document giving consent to
the change of usage of 22 St Andrew Square? If exemption are given,
please give exact reasons.
6. How often does Hastings Borough Council check the premises to
ensure compliance to planning permissions and use?

Dear Information Officer,
I should be grateful if you can conduct an internal review to my
FOI requests.
The questions I asked are as follows:
1. Can you advise me what date Hastings Borough council gave it
consent to the change of 22 St Andrews Square from commercial
residence into private residence.
This information must be available as No. 22 are now six blocks of
flats plus commercial premises. The Council charges Council Tax on
all of the six flat plus commercial residence (named Londis).
Therefore the information is available. Please supply.
Question 2 and 3 - I will accept, however I am surprised that
Hastings Building Control were not aware of this unit, considering
it is a large unit and they were the authority that gave consent to
the whole building of 22 St Andrew Square between 2002 and 2007.
Question 4 - I will accept.
Question 5 - Again I know that Hastings Borough Control/Planning
Department would have this information. They were the authority
that granted change of use of the whole block of 22 St Andrews
Square in 2002 for the shop and in 2007 for block of flats. Again
please supply this information or provide me with an exemption
under the FOIA so that if this needs to go to the ICO this can be
investigated.
Question 6 - again I will have to accept this although I am
surprised that the Council do not investigate on their own
initiatives with regard to planning use of property from one type
of use to another.
I therefore require an Internal Review with regard to questions 1
and 5 as I believe there is information that Hastings Borough
Council can supply but are not willing to do so. I wonder why?
From information I have received. The Londis shop was granted a 15
year lease from 2002 and the individual flats were granted 125 year
lease from 2007. Therefore the Council would be in a position to
deal with this information.

Information relating to 22 St Andrews Square, Hastings:
The date Hastings Building Control gave its consent to change the above
commercial residence into private residence.
A copy of the document giving consent to the change of usage of 22 St
Andrew Square.
On 09 August 1988 application HS/FA/88/662 was granted permission with
conditions for the conversion of the upper floors of 22 St Andrews Square
to form a four bedroom maisonette. The ground floor of the property is
used for storage.
The information requested is publicly available information, and is held
on our planning files. As such it is information that is reasonably
accessible to the applicant and therefore exempt information under S21 of
the Freedom of Information Act 2000. A guide to such information is
