Dear Ms Higgins

FREEDOM OF INFORMATION (SCOTLAND) ACT 2002 - INFORMATION REQUEST

[FOI/2009/1296]

Your request for information will not be processed.

This is because the cost of complying with your information request exceeds the “prescribed amount” of £600 as stated in the Fee Regulations issued under the Act. It is estimated that it would cost £825.00 to comply with your request.

In accordance with the Freedom of Information (Scotland) Act 2002 Section 12 the Council is not required to comply with your request.

You may wish to refine and resubmit your request so that it reduces the cost to within the “prescribed amount”. Please contact me if you would like some advice on refining your request.

However, I can advise that the Barnett Formula consequential due to Scotland as a result of HM Treasury's announcement of £340m to support families with disabled children in connection with the report Aiming High for Disabled Children were included within the overall Scottish Budget resulting from the Comprehensive Spending Review 2007 Settlement, and were not hypothecated.

You have the right of appeal against the decision. If you wish to appeal please set out in writing your grounds of appeal and send to Alison Nelson, FOI Lead Officer, South Ayrshire Council, Corporate Services, County Buildings, Wellington Square, Ayr KA7 1DR, Tel: 01292 612462, E-mail: [email address] or alternatively Ewan McCrindle, FOI Officer, located at the same address, Tel: 01292 612127, E-mail [email address] to be received, or posted in time to be received, no later than 5 February 2010.

You also have a right of appeal to the Scottish Information Commissioner at: Kinburn Castle, Doubledykes Road, St Andrews, Fife KY16 9DS, Tel: 01334 464610 E-mail: [email address] Website: www.itspublicknowledge.info.

Yours sincerely
