REQUEST FOR INFORMATION

I refer to your request for information dated 15 December 2009 and apologise unreservedly for the delay in responding to you. This was due to several factors, including the festive period, the audit process not being fully implemented and one of the main contributors being off work. I hope you accept this apology in the spirit it is given and the matter will be the subject of a forthcoming Internal Review.

I am sorry to advise you that the decision was made not to grant your request, and in accordance with the Freedom of Information (Scotland) Act 2002, this letter is a Notice that information is not held.

Part 1, Section 17, 1 (b) of the Freedom of Information (Scotland) Act 2002 requires Dumfries and Galloway Council, to advise you that we do not hold that information.

The Barnett Formula consequentials due to Scotland as a result of HM Treasury's announcement of £340m to support families with disabled children in connection with the report Aiming High for Disabled Children were included within the overall Scottish Budget resulting from the Comprehensive Spending Review 2007 Settlement, and were not hypothecated.

As a result the Council does not hold the information you have requested.

You should be aware that the Council holds the copyright for the material provided and it may be reproduced free of charge in any format or media without requiring specific permission. This is subject to the material not being used in a derogatory manner or in a misleading context. The source of the material must be acknowledged as Dumfries and Galloway Council and the title of the document must be included when being reproduced as part of another publication or service.
