Freedom of Information (Scotland) Act 2002 - (“The Act”)

I refer to your request for information from the Council dated 8 November 2009, requesting information relating to funding disabled children.

I understand that the Barnett Formula consequentials due to Scotland as a result of HM Treasury's announcement of £340m to support families with disabled children in connection with the report Aiming High for Disabled Children were included within the overall Scottish Budget resulting from the Comprehensive Spending Review 2007 Settlement, and were not hypothecated.

As this funding was not ring-fenced it is not identifiable in Aberdeenshire Council's budget. Therefore, under Section 17 of the Freedom of Information (Scotland) Act 2002, the Council believes that it does not hold the information requested.
