Dear Mr Peasgill

I refer to your email of 22 December to Ms Pook, Communications and Records Manager, seeking an internal review of her response to your Freedom of Information Act (FOIA) request, sent to you on 25 November 2009.

I have reviewed Ms Pook's response and consider it accurate and comprehensive.

The Code of Conduct that she forwarded to you is the current code; the amendments you refer to were made in accordance with the Commission's approved procedures and within its legal powers. The Code you refer to has been superseded by the Commission's publication scheme which is available on its website (
www.lgo.org.uk).

You have added a number of supplementary questions. These are not requests for information that are within the Commission's records and therefore do not fall within the scope of the FOIA.

As Ms Pook has pointed
out, we are not in a position to give definitive answers to hypothetical questions. If you wish to ask specific questions on a particular case then I suggest you pursue this with the relevant Ombudsman's office.

If you are not content with my decision on this matter you may raise a complaint with the Information Commissioner. His contact details are on the website www.ico.gov.uk.

Yours sincerely
