Appeal under the Freedom of Information Act

I write further to your email dated 24 November 2009, seeking a review of the decision of the City Council to refuse your request,

Request

A black slurry repair has recently been applied to pavements in parts of Kings Heath where tarmacadam was previously applied. Residents suggest this has been ongoing for at least two years but is unclear. Certain streets have not been completed.

1) Please list those streets whose pavements have already been resurfaced.

2) Please list those streets that have yet to be completed.

3) Please provide the name or reference number of this project and the overall cost incurred thus far and monies available to complete the project.

An Appeal Panel met on Tuesday 19 January 2010, to consider your request for a review, in deliberating its decision the panel gave consideration to:

The Panel upheld the original decision.

The panel felt that the directorate had provided the information requested. With regard to the query arising from the response relating to the works on Westfield Road, the panel felt that whilst there was a slight delay in providing the information, this was due to an officer having to make checks on Westfield Road to ensure that information was correct. The panel noted that whilst the works may denote a single road, the corresponding work may result in surrounding roads being treated. The panel felt the FOI request had been dealt with adequately and appropriately.
