Thank you for your recent request, which was received by Cafcass on 19th October 2009
requesting the following:
1. I would like to know who is responsible for Cafcass Guardian Ad
Litems presenting falsified evidence court, committing perjury and
perverting the course of justice?
2. Who is responsible for the above misconduct?
3. What is the Cafcass Complaints Procedure?
4. What disciplinary action would be taken against any Cafcass
Officer found to be guilty of such misconduct?
5. What employment conditions would the Cafcass Officer be in
breach of?

Significant factual errors (not matters disputed by the parties) in the Guardians report should
be referred to the Guardian. Concerns about other aspects of the Cafcass report (for
example, the extent of the enquiries, the opinions expresses in it or matters disputed by the
parties) must be addressed in court.

Complaints about a Cafcass Guardian should be addressed via a complaint to the Guardians
line manager. The complaints policy can be found at the following link:

If the situation you have described above happened in court, the legal teams within the court
are able to address any falsified evidence at the time.
The attached performance and conduct policy describes the Cafcass process.
If you are unhappy with the decisions made in relation to your request, you may ask for an
internal review to be undertaken. If you are dissatisfied with the way the internal review is
handled or with the final decision made at that review about the information released, you are
