Re: Freedom of Information Request 4521

Thank you for your recent request to the Council. You asked to be provided with the following information:

  1. How many times have you reviewed your procedures and reminded staff of their obligation under the FOI Act 2000 (from 01/01/2009 to the present day)?

  1. Please provide the outcome of each review of your procedures and include what changes were made to your procedures.

  1. What disciplinary measures are in place for staff who repeatedly have to be reminded of their obligations under the FOI Act 2000?

Response

We are unable to provide the requested information in respect of question 1 and 2 above.

Whilst I can confirm that we remind staff of their obligations on an ongoing basis, i.e. daily, this is done via a number of means, some of which are not centrally recorded. For example, we remind staff through team briefings, training sessions, one-to-one discussions, email and by telephone.

Similarly, we review our procedures on an ongoing basis as issues are identified, but the outcomes of such reviews, and any subsequent changes made, may not be centrally recorded, such as if they are discussed verbally or via email.

We are, therefore, unable to provide the requested information: this is because the cost of locating and retrieving the information exceeds the “appropriate limit” as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004. It is estimated that it would cost £825 to comply with your request. This is based on looking through our records to locate and retrieve any emails in which such measures are discussed.

You have the right of appeal against the decision. If you wish to appeal please set out in writing your grounds of appeal and send it to the address at the top of this letter.

Should you still be dissatisfied with the outcome of any such complaint you have the right to make a complaint to the Information Commissioner, pursuant to section 50 of the FOIA. The contact details are:

As regards question 3, I can confirm that there are currently no disciplinary measures in place for staff who repeatedly have to be reminded of their obligations under the FOI Act 2000.
