Freedom of Information (Scotland) Act 2002 - (“The Act”)
I refer to your request for information from the Council dated 12 October 2009 concerning the following information:
1. Has your authority ever found a member of the BNP or any other political Party guilty of a disciplinary offence related to their Party membership whilst teaching in the last three years? If so please give information as to when and how many.
2. Has any parent complained to you regarding the Party membership of any employee or the expression of political views within School classrooms under your authority during the last three years?
3. What safeguards do you currently have in place to prevent members of any political Party promoting their views within Schools?
In the last three years no teachers within Aberdeenshire have been subject to disciplinary procedures relating to political party membership.
We have no records of any complaints from parents regarding the party membership of any employee or the expression of political views within school classrooms under our authority during the last three years.
Whilst we do not have a specific policy relating to this area, we require all of our employees to treat anyone that they come into contact with in their capacity as an Aberdeenshire Council employee with dignity and respect. We have a number of wider policies covering acceptable behaviour including Dignity of the Individual policy and Equality and Diversity policy. These operate in conjunction with other policies such as Disciplinary, Grievance and Work Performance Ability. In addition each school has individual policies relating to acceptable behaviour.
All of our teachers are required to be registered with GTCS and as such we require them to follow the GTCS Code of Professionalism and Conduct.

no later than 40 days after you receive the Notice intimating the decision that you want to have reviewed.
Your request for review must be in writing or in another form which has some permanency and is capable of being used for subsequent reference (e.g. audio/video tape recording). You must state your name and address for correspondence. You must also give details of the information which you originally requested and the reasons why you are dissatisfied with the way in which your application for information has been dealt with.
The Principal Committee Officer will arrange for your application for review to be considered by the Review Panel. The Review Panel will write to you informing you of its decision by not later than twenty working days after receipt of your request for a review. The Review Panel will also provide you with a statement of its reasons for arriving at the decision it has made.
Your Right to Complain to the Scottish Information Commissioner:
If you are dissatisfied with the Review Panel's decision, you may appeal to the Scottish Information Commissioner.
An appeal to the Scottish Information Commissioner must be made within six months, specifying:-
the Request for Information to which the requirement for review by relates;
the reasons for your dissatisfaction with the review decision;
