Thank you for your email dated 11^th October, 2009.

I have reviewed your request under the Freedom of Information Act 2000, and my response is as follows:

In relation to question 1: The Council has not served any Local Government Act Part III Section 32(3) notices on a Local Government Ombudsman over the last 5 years. Therefore, the Council has not been found guilty of maladministration for misusing a Section 32 (3) notice for the same period.

Right to Review

If you wish to have this decision reviewed please write to the Director of Business outlining the points of your review.

If you are still not satisfied with the Council's decision following any review you may appeal the Council's decision to the Information Commissioners Officer, Wycliffe House, Water Lane, Wilmslow, Cheshire. SK9 5AF.
