Thank you for your recent  request for information under the freedom of information act 
2000.  
Under section 12 of the Act, the Council does not have to comply with a request for 
information if the cost of compliance exceeds the appropriate limit.  For the Council, the 
appropriate limit is set at Â£450 or 18 hours at £25 an hour.   
Section 32(3) notices are not routinely recorded and we therefore estimate that to provide 
the information you have asked for at question 1 would exceed the appropriate limit since 
this would require accessing  1164 cases which were determined by the Ombudsman in the 
last 5 years and we would expect these checks to exceed 50 days to complete.  
 
 
(1) Over the last 5 years how many Local Government Act Part III Section 32(3) notices has 
your council served on a Local Government Ombudsman.

(2) Over the last 5 years how many times has the Ombudsman concerned found the council 
guilty of maladministration for misusing a Section 32(3) notice. 
 
I can confirm that over the last five years Leeds City Council has not been found guilty of 
maladministration for the use of a section 32 notice.
