2008-11 National Affordable Housing programme.

2) The timetable for announcement of successfull bids/grant
allocations under the 2011-15 Affordable Homes Programme.

3) Bid details, evaluation, and status of any bid under the above
programme (or any other current programme being run by the HCA) to
redevelop the Priory/Platt Court in Hungerford, Berkshire. Details
to include all bid related documentation with Sovereign Development
Consortium/Sovereign South & West/Sovereign Group, West Berkshire
Council, their agents, and any other potential development partner
for this site. Documentation to include letters, e-mails,
notes/minutes of meetings, notes of telephone calls and printouts
of all details submitted electronically or via IMS, whether held as
a 'bid' or as part of your 'forward allocation pool'.

Dear Homes and Communities Agency,

Following a FOI response from Bracknell Forest Borough Council who
led the Berkshire LIP process, I would like to extend part 3 of my
request to include all West Berkshire Extra Care schemes.

Although the Priory features as a named scheme in the LIP,
Bracknell Forest Borough Council seem to be indicating that it may
be rolled in with other developments under the more generic name of
'West Berkshire Extra Care schemes'.

Despite Sovereign apparently not applying for HCA funding for this scheme, and the "risk" of not being able to build the scheme without the funding, as per the Berkshire LIP http://www.bracknell-forest.gov.uk/berks... ,Sovereign have already commenced the demolition of the existing buildings without discharge of the pre conditions attached to the planning permission. West Berkshire Council who are "in partnership" with Sovereign for the development do not deem it "expedient" to enforce the conditions...

I would be grateful if you would pass this request for internal
review of part 3 of the request in light of the information
received from Natural England. For clarity, I have reproduced the
question below:

Thank you for your response. I am indeed unsatisfied with it, and
will be taking it to the Information Commissioner.

Furthermore I would like to draw your attention to the final

Thank you for your emails, addressed to my colleague Catherine Talbot.

We appreciate that our response may have caused some confusion, so would like to provide the following explanation.

Your email of 16 November 2011 was understood to request an Internal Review of our handling of your Request for Information, RFI:8692-11. We interpreted the final paragraph of that email (and reproduced in your email of 14 December 2011) to relate to the information "held" at the time of your original request, and not to represent any further Request for Information. Where you asked for the information "previously requested, and re-requested now", we understood this to relate to the information you believed to have been held at the time of the previous Request. As you will be aware, the purpose of an Internal Review is to establish whether a Request was appropriately considered, and not to look at the disclosure of additional information outside the scope of the original Request. As such, my colleagues' investigations undertook to establish only whether the previous response was correct; they did not consider the disclosure of the information received since that time.

However, in view of your comments, we have logged a new Request for Information, RFI:9247-11, to consider the provision of the information received since the date of your original Request (RFI:8692-11). Our acknowledgement is attached. We appreciate that you may, of course, proceed to contact the ICO with regards to our handling of RFI:8692-11, and we would be fully cooperative with any investigations.

We would apologise for any confusion, and hope that you will be able to bear with us whilst we investigate your new Request for Information. However, if you have any queries or questions in the meantime, please do not hesitate to contact me directly.

Dear Catherine West,

Many thanks for your response. I would like to request an internal
review, as I cannot believe that this is all the information that
you hold in relation to the Priory/Platt Court development, or that
calling it a different name - 'Berkshire-West', or 'Priory Road',
exempts you from disclosure either under the FOI Act or the
Environmental Information Regulations, which may be applicable in
this case.

Furthermore, I do not accept your reasons for the non disclosure of
the total bid of which this development now forms a part,
particularly under the EIR's which have a stronger presumption in
favour of disclosure.

I would be grateful if you would perform the review under the FOI
Act and the EIR's should you feel that they are applicable, so as
not to delay matters should the non disclosure be upheld by
yourselves and the matter then referred on to the ICO.

I shall be pursuing the explanation given of the late
addition/substitution of the Priory/Platt Court development into
the bid/grant with your internal and external auditors. I am well
aware that the development was included in the Berkshire LIP, but
have been unable to establish why, as it didn't meet sufficient of
the criteria to merit it's inclusion (pre-planning)or priority. I
can only conclude that incorrect information was supplied, as it
was to the HCA in support of the previous two unsuccessful bids for
the project under the previous scheme and to Natural England in
support of the bat licence. Furthermore, the details downloaded
from your IMS system are inconsistent with the details of the LIP
which seems to have prioritised this scheme as an 'Extra Care/over
55' scheme of more than 50 affordable units. I notice that the
revised details on your IMS system are for 34 units. I also notice
that the site is classified as "brownfield" although the applicants
acknowledged in their planning application that this was not the
case, following changes to PPS3 made by the current government.
