Dear Tower Hamlets Homes Limited,
I am writing to request information under the Freedom of
Information Act 2000. In order to assist you with this request, I
am outlining my query as specifically as possible.
I request details of market testing and benchmarking carried out in
2009/10 to ensure best value. This includes phone and telephone
surveys. Details would include, but not be limited to, the text of
surveys and their responses (as any reputable survey would make
public anyway), names of benchmarking bodies, copies of reports
and/or emails that say how you think THH compares and the rationale
behind it.
I would be interested in any information held by your organisation
regarding my request. I understand that I do not have to specify
particular files or documents and that it is the department's
responsibility to provide the information I require. If you need
further clarification, please contact me at this email address.
This request covers all blocks and estates managed by Tower Hamlets
Homes.
I would like to receive the information in open semantic electronic
form. (PDF is not open.)
Please provide tables, particularly very big ones, in an electronic
format that preserves both the machine-readable and human readable
information. Tables, for example, could be in XML, CSV, or Open
Document spreadsheet formats. This should also take less time for
you to prepare: you presumably already have the information on
computers. WhatDoTheyKnow.com lets you upload files. Google
documents offer one way of sharing spreadsheets publicly.
In the long run, I encourage you to provide this data on your
website. Data.gov.uk has information for public bodies about
releasing data:

If my request is denied in whole or in part, I ask that you justify
all deletions by reference to specific exemptions of the act. I
will also expect you to release all non-exempt material. I reserve
the right to appeal your decision to withold any information or to
charge excessive fees.

The Council has decided that your request for information will not be

It is estimated that the cost of locating and retrieving the information

Please pass this on to the person who conducts Freedom of
Information reviews.
I am writing to request an internal review of Tower Hamlets Homes
Limited's handling of my FOI request '2009/10 Service Charges
Market Testing'.
If these market testing documents are available to THH staff in any
efficient way, making it available to the public should be trivial.
The time taken itself is not credible.
The response failed to fulfill your duty to provide assistance. You
should have explored ways to reduce the fees.
It did not substantiate or itemise the fees, making it impossible
for me to refine the request.

Dear Mr McDonald,
Review of FOI request 4517 - Market testing and benchmarking
On 15 May 2011, you sought a review of the Council's decision of 6 April
2011 not to process your request for information on grounds of cost.
I have considered the categories of information falling within your
request and the time necessary to compile a response. It seems to me that
the information falls within the following categories -
1. The annual benchmarking survey for ALMOs and London
based local authorities for 2009/2010.
2. Internal reports.
3. Ad hoc exercises conducted in email exchanges that
have never been made the subject of report.
All of this material is likely to contain information that was either
provided to Tower Hamlets Homes Ltd subject to obligations of confidence,
or which would prejudice the commercial interests of either Tower Hamlets
Homes Ltd or the organisation providing it were it to be disclosed. It is
my view that the exemptions contained in sections 41 and 43 of the Freedom
of Information Act 2000 would apply to that extent. Section 41
(obligations of confidentiality) is an absolute exemption. Section 43 is
not an absolute exemption, but it is my view that disclosure may prejudice
Tower Hamlets Homes' ability to participate in benchmarking exercises and
in my view the public interest favours non-disclosure. Accordingly, I
think that the material must be redacted to exclude the confidential and
commercial sensitive material.
I do not see any time impediment to producing the reports in 1 and 2 above
with appropriate exclusions. To this extent I uphold your complaint and I
enclose copies of the redacted reports.
I have consulted with Tower Hamlets Homes Ltd about the time necessary to
locate emails comprising ad hoc exercises that have not subsequently been
made the subject of reports. I believe that this would require 3 days or
21 hours of officer time. In respect of this material I uphold the
initial response.
