Dear Tower Hamlets Homes Limited,

With respect to the 2008/9 Service Charge actuals, I would be
grateful if you could provide some more detailed information.

I request:

a. Full and comprehensive breakdown of all actual costs (2008/9)
incurred for the provision of services.

b. Annual budget review appraisal of the housing management cost
centres

c. Details of market testing carried out in 2008/9 to ensure best
value.

I am asking via WhatDoTheyKnow.com to save you time in future. If
you supply this information to me in public, then you can point
other leaseholders who request the same information to the answers
you gave me.

Please provide tables, particularly very big ones, (such as the
breakdown requested in (a) above) in an electronic format that
preserves both the machine-readable and human readable information.
Tables, for example, could be in XML, CSV, or Open Document
spreadsheet formats. This should also take less time for you to
prepare: you presumably already have the information on computers.

In the long run, I encourage you to provide this data on your
website. Data.gov.uk has information for public bodies about
releasing data:

Mike Tighe requested clarification on this request in response to
another:

As you are the only person who has formally replied at the address
given in the request, you are technically the only person who has
responded for THH, so I am replying to you.

Mike asked to which estate and block this request refers. It refers
to all of them.

I think that asking for all estates and blocks is the most
efficient and open thing to do. You already hold the data
electronically. Exporting for all estates and blocks should be no
more work than exporting it for one. As I said initially, you can
point other leaseholders who request the same information to this
response.

Please pass this on to Michael Tighe and other colleagues as
needed.

Dear Tower Hamlets Homes Limited,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Tower Hamlets Homes
Limited's handling of my FOI request '2008/9 Service Charges:
Costs'.

I was informed almost two months ago by Michael Tighe that Geoff
Payne was compiling the information for a separate FoI request.
I think Michael meant that he was compiling the information for
this request also.

Michael Tighe wrote "We endeavour to answer all FOI requests within
20 working days, however in certain cases, this may take slightly
longer." I remind you that your legal obligation is not to
endeavour to answer within 20 days, but to answer.

Naturally (and without prejudice), I would not be asking you for an
internal review if answering had taken "slightly longer". But this
request was clarified on May 1 (after being made on Feb 27), so is
long overdue.

This cost information would help make THH's work
more transparent to its tenants and leaseholders, so I look forward
to your answer.

corporate complaints unit.

I am writing to request an internal review of Tower Hamlets Homes
Limited's handling of my FOI request '2008/9 Service Charges:
Costs'.

I encourage you to respond to the address given so that the reply
is posted there, so that others can easily make use of the
information.

Tim Rodgers refused (a) under a section 21 exemption. This only
applies if the information is publicly available elsewhere. LBTH
claimed section 21 exemption on the basis of an unsubstantiated
claim that the information used to be available to a tiny subset of
the public.

In the process of ignoring section 21, LBTH also ignored section
17, which obliges the authority to provide help and assistance. The
guidance states that “there should be no possibility of applicants
being left in any doubt as to how they can obtain the information
which they want”. Instead, LBTH made only an oblique reference that
means absolutely nothing to me.

The answer to (b) appraised nothing and reviewed nothing. It was
not the requested annual budget review appraisal. Please supply the
information requested.

The answer to part (c) fails to answer the request in several ways.

LBTH gave no detail, described no market testing, and only
mentioned management fees. Were it part of an answer, the
description of benchmarking should at least have said which ALMOs,
which local authorities, and how the landlord compared to them.

The answer describes no market testing at all for administration or
any other costs. If the landlord did no market testing for these,
then please make that clear. But if it did (eg phone surveys), then
the authority should provide details (eg questions, and answers to
each one, and costs of the survey).

The answer appears to be about market testing carried out not in
2008/9, but afterwards.

Please contact me for clarification if you are not clear about any
of my questions. If you think my request has been formulated badly,
please offer help and assistance as section 17 requires before
answering a question which was entirely different to the one I
asked.

The claimed exemption makes this a little more complicated. Just to
keep things a bit clearer, please don't conflate your response to
this appeal with any others.

Re: FW: 2773 Stage 3 Complaint 1-48964475- FOI Mr I McDonald

I am writing to confirm that I arranged for Jill Bell Head of Legal
Services (Environment) to deal with your request made to Tower Hamlet
Homes Limited on 9^th September 2010 for an internal review of the
handling of your FOI request regarding 2008/9 Service Charges Costs. As
requested this response is being posted on the whatdotheyknow website
rather than sent to you direct.

The points that you made in your request are addressed one by one

1. Tim Rodgers refused (a) under a section 21 exemption but you state
that this information is not publicly available elsewhere and in doing
so he ignored the duty of advice and assistance under section 17.

The review has shown that this material is reasonably accessible in that
leaseholders are entitled to inspect the actuals up to 6 months after the
final accounts are prepared. Section 21 of the Freedom of Information Act
deals with Information accessible to the applicant by other means.
Section 21(1) states "Information which is reasonably accessible to the
applicant otherwise than under section 1 (which is the general right of
access to information) is exempt information . In these circumstances Mr
Rodgers response was appropriate.

2. The information supplied on the annual budget review appraisal of the
housing management cost centre did not appraise or review that
material.

It would appear that the officers dealing with your request were not clear
what you were asking for and should have asked you for clarification. If
you are asking for a copy of a report detailing the appraisal and review
of the housing management cost centre then such a document does not exist.

3. No detail was provided of the market testing for 2008/9 to ensure best
value

In the response Mr Rodgers stated that THH had undertook benchmarking. He
should have confirmed that there was no market testing. THH is part of a
benchmarking group which includes ALMOs in the London and South area as
well as a benchmarking group for London housing providers and a national
one (Housemark). The benchmarking clubs provide an opportunity for
housing providers to compare themselves against similar organisations on
various measures including administration charges. Unfortunately for the
purposes of your enquiry it is a term of the membership that the
benchmarking reports remain confidential to the members of the
benchmarking club and THH are therefore unable to supply a copy. There
were no phone surveys or survey reports so there are no documents to
disclose.

I confirm that there are no further internal review processes available
through London Borough of Tower Hamlets.
