Re Complaint 
 
 
I write to inform you that I have investigated your complaint regarding the 
application of s40 (2) of the Freedom of Information Act, to your request dated 
7/10/09.  
 
You requested a copy of the local authority’s response to the DCSF regarding 
a call for further information relating to the review. I can confirm that the 
authority did not respond by completing the excel spreadsheet sent by the 
DCSF. However, we did send an email about one specific case which 
contained personal data as defined by the Data Protection Act 1998. To 
attempt to redact this would have rendered the email unreadable, therefore it 
was withheld in full. I therefore have concluded that we have properly applied 
the s40 (2) exemption.
