I refer to your e-mail of 3 November 2009 when you again asked for details of the response to the call made by Graham Badman on 19 September.

Given your e-mail, we have again contacted the relevant department and can confirm that as detailed in our letter of 3 November 2009, the Council has no record of a response being provided to this request, ie there was no response made to this further call.

The Council cannot provide information that it does not hold and is not obliged to create information in order to respond to an FOI request. No further information can therefore be provided in relation to your request. Our letter of 3 November did state that there had been no response and this would indicate that the information was not held, accordingly I do consider that the requirements of s.1(1)(a) (to inform whether or not the information was held) was complied with.

The remaining details given in our letter were for assistance purposes. It is therefore considered that your request was responded to on 3 November.

I also note that on 5 November you asked for a review of the handling of your request on the basis that we had not responded to you within the statutory time limits.

Your original request was made on 7 October 2009 at 9.17pm. It was therefore deemed received on 8 October 2009. The statutory time starts from the day after receipt of the request (section 10(1) Freedom of Information Act 2000), in this case 9 October 2009. The 20^th working day was accordingly 5 November 2009. As stated our response was given on 3 November which is within the 20 working days.

In view of the above and given that your e-mail of 5 November may have crossed with our response, can you please confirm whether you still wish a review of the handling of your request to be conducted. If you do still wish a review to be conducted the matter will be passed to Mr Edwards as detailed in our original letter.
