Request for Information - Qualified Exemptions
On 8 October 2009 East Riding of Yorkshire Council received your request for information under the Freedom of Information Act 2000. The information you requested, along with the Council's response, is set out below.
Details of request:
Please supply the Local Authority response made to Graham Badman's call on 17 September 2009 for further evidence regarding the Report into Home Education.
On 17 September, Graham Badman via a DCSF email made a further call for evidence to Local Authorities regarding the Review/Report into Elective Home Education.
I am requesting East Riding of Yorkshire's response to that call.
I confirm that the Council holds information in relation to your particular request. However in this instance the information cannot be communicated to you. This is because the Council considers that the information requested is exempt information within Part II of the Act. The particular exemption is Section 40, which is concerned with Personal Data within the meaning of the Data Protection Act 1998.
Section 40 applies to person data of someone else and the council believes that disclosure of the information would contravene principle 2 of the Data Protection Act
We have attached a copy of the DCSF letter and refer you to page 3 under “background information/case studies, in the last sentence…These will be treated in strictest confidence …”
If you are dissatisfied with the above decision you can ask for the Council to review this by contacting the Freedom of Information Coordinator on the above telephone number or by email on [email address] within 6 weeks of this letter which is 13 December 2009.
If you are unhappy with the way your request has been handled this can also be considered within the review process.
A senior manager will carry out the review within 10 working days of receipt of your request and provide a response within 20 working days. It will provide a fair and thorough review of the decisions taken and where necessary how your request has been handled, including decisions taken as to where the public interest lies in respect of exempt information.
If you are not content with the outcome of the review you can apply to the Information Commissioner for a decision. Generally, the Commissioner cannot make a decision unless you have exhausted the Council's review procedure. The Information Commissioner can be contacted at:
