FREEDOM OF INFORMATION REQUEST REF NO FOI/09/01397

I am writing regarding your request for information, which was received on 6^th October. In that request, you asked for information concerning advice provided by the Scottish Government to Scottish Police Forces in relation to the retention of arrest records in respect of persons who have not been convicted of any offence.

In order to identify and locate the information you have asked for, further details are required to clarify aspects of your request. In particular, it would be useful to know what you mean precisely by the term “Arrest Records.” Additionally, could you also please advise if the reference to non conviction relates only to the specific offence for which the person was arrested or if you mean a person who holds no convictions whatsoever.
