Re: FOI 86730 Review
Thank you for your email of 21st December 2009 in which you requested an internal review of our handling of your Freedom of information request numbered above.
In your original request you specifically asked for the following information to be supplied:-
A list of all investigations procured by Liverpool City Council into the operation of Liverpool Direct business and contracts, including the names of the consultants involved, budget, and relevant dates. (This would include any investigations undertaken prior to the signing of this unique contract).
Copies of all reports relating to the past and future operation of Liverpool Direct Limited available to the council for reference.
In our response to you we dealt with the specific questions which you posed.
In compliance with our obligations under Section 16 of the Freedom of Information Act 2000 (FOIA) we provided information as to how no investigations had been carried out or commissioned in relation to Liverpool Direct Limited (LDL). We further informed you that during the course of other investigations into areas of business across Liverpool City Council, involving some 175 reports, there may have been aspects of work present or future for LDL. In our response, it was identified to you that in order to determine which, if any of these reports contained any such reference, each report would need to be reviewed and that this process would exceed the appropriate amount of time required to comply with such requests.
It is noted that you have stated that you began your original request with a specific reference to at least one such report. However, having inspected the documents which you have identified in your request, specifically the CPA report and the Financial Peer Review can confirm that they were not investigations by Liverpool City Council into the operation of LDL, nor are they reports relating to the past or future operation of LDL and as such were not disclosed to you as they did not comply with your request.
Having reviewed your request and our response, I do not believe that the original response provided to you was in breach of the act and that the response provided complied with your request. Consequently your appeal against our original response is not upheld.
If you remain dissatisfied you may also apply to the Information Commissioner for a decision about whether the request for information has been dealt with in accordance with the Freedom of Information Act 2000.
