Freedom of Information (FOI) Act 2000: Request for information

Thank you for your reply dated 30 November 2009, relating to FOI/4438. I am sorry you are dissatisfied with my first response; I shall endeavour to further clarify each of the points you raised in turn.

In your reply you stated: “Thanks for your response, however some questions were left unanswered or detail was not available where stated.

The following relate to my original numbered questions.

1. I have no email from WCC requesting any further information. I'd be more than happy to give you what you need, please resend the original and I will respond immediately.

2. As there is no contract, could you supply terms of the lease please?

3. So the free motorcycle parking supplied by WCC has reduced (regardless of whether Titan supply it or not) so why isn't this reflected in WCC's public documents?

5. I'm afraid the following URL does not provide the answer I requested:

The URL does not show how many "free" or paid parking spaces have changed before the lease to Titan Parking and afterwards as supplied by Westminster Council.

In short, how many spaces were supplied by WCC before and after leases were taken by Titan Parking?

6 As the lease of the two car parks to Titan Parking were after the WCC funded the costs of marking motorcycle parking bays, was the money recovered or just given as part of the lease?

7 I asked for what the repairs were and the costs that were carried out prior to the lease, you haven't provided that answer.

In response to your follow-up request I can advise you of the following.

  1. Please find attached e-mail file “FOI4438 Tonith hold email” dated and sent 28 October 2009; due to technical difficulties, no proof can be found that this e-mail was delivered successfully.

  1. The Heads of Terms extract relevant to your question is as follows: the lease provides for the main terms of the proposed letting…by the Lessor: Westminster City Council, to the Lessee: Overix 3 Limited, a wholly owned subsidiary of Titan Parking Limited.

The Lease is a new effective Full Repairing and Insuring (FRI) lease outside the security of tenure provisions of the Landlord and Tenant Act 1954 for a term of 3 years. The Lessee is permitted to use car park for the parking of vehicles/motor cycles/bicycles/car washing and ancillary accommodation subject to planning.

All occupation (by third parties) of the car park, as necessary for the purposes of operating a car parking business, will be under agreements which do not provide any security of tenure.

  1. This has been reflected in the Cabinet Member Report, the following extract, from paragraph 4.7.15, states:

“Between January 2007 and August 2008 we increased the provision of spaces for motorcyclists by 44% from 4,500 bays to 6,500, including approximately 400 in our secure off-street car parks. Since the Cabinet Member's decision on 20 May 2009 to make the scheme permanent, we increased our off-street provision to 1,053 spaces (although…this has regrettably dropped to 883 spaces from 1 September 2009), all of which has become free of charge, and signage is being erected to direct motorists to our off-street car parks. The Cabinet Member's commitment to increase off-street provision included the proviso that should take up of the off-street space deem it necessary, further work would be undertaken to identify further space on-street.” Please use the link below for further details:

Before WCC leased Leicester Square and Chiltern Street car parks to Titan Parking, there were 1053 motorcycle parking spaces within the city council car parks. After the handover to Titan Parking, a total of 883 remain under the control of Westminster, as stated above.

  1. There are no funds to be recovered; the marking of the motorcycle bays fell within the remit of general parking maintenance and running costs. As leaseholders, Titan will continue with their own maintenance as they see fit.

  1. As previously stated, WCC carried out general maintenance prior to the handover; the costs were unavailable as they were included within the day-to-day running costs of the car parks.
