RE: Request for information under the Freedom of Information Act

I am writing in response to your recent request for information, directed to Hertfordshire County Council, in which you requested information relating to Hertfordshire County Council Corporate Services. Your request was forwarded to Her Majesty's Courts Service (HMCS) on 5th October 2009 as information relating to court cases is held by HMCS, and your request has been handled under the Freedom of Information Act 2000 (FOIA).

It is unclear from your request precisely what information you are requesting. However, I assume you are asking for information relating to court cases and county court judgments in the name of Hertfordshire County Council Corporate Services. If this is the case, this information is exempt under Section 32(1) of the Freedom of Information Act. This section exempts information contained in certain documents created by courts and held on court files. It is an absolute exemption and there is no duty to consider the public interest in disclosure.

You may however wish to contact the courts directly as release is at their discreation.

I am sorry that I cannot be of more assistance on this occasion.

As part of our obligations under the FOIA, the MoJ has an independent review process. If you are dissatisfied with this decision, you may write to request an internal review. The internal review will be carried out by someone who did not make the original decision, and they will re-assess how HMCS handled the original request.
