I write in connection with your request for information received on 11th September 
2009.  You asked:

Q1 All the information you released to the requestor prior to the decision by the 
Information Commissioner [Reference: FS50183238] and; 
 
Q2. Copies all the information you have now been ordered to disclose as a result of 
the decision notice. 
In relation to the first part of your question, I can confirm that the information is held by 
Surrey Police.  The information that is relevant to this part is contained in an 
acknowledgement letter; a response letter signed by the then Chief Constable, Bob 
Quick and finally a letter from our Internal Review Team to the applicant.

In relation to the second part of your question, as you have rightly stated, a Decision 
Notice has been served on Surrey Police by the ICO requiring disclosure of the 
information.  Surrey Police is currently in the process of preparing an appeal to the 
Information Tribunal against this decision.   
 
Until such time as the appeal is heard by the Information Tribunal, the current Chief 
Constable Mark Rowley stands by the decision of the previous Chief Constable.  I 
draw your attention to the response letter which I have included in answer to the first

part of your request.  Surrey Police consider that this response is still valid until after 
the Tribunal has made its ruling.  
 
Section 17 of the Freedom of Information Act 2000 requires Surrey Police, when 
refusing to provide such information (because the information is exempt) to provide 
the applicant with a notice which: (a) states that fact, (b) specifies the exemption in 
question and (c) states (if that would not otherwise be apparent) why the exemption 
applies. Accordingly this letter serves as such a notice.  
 
Surrey Police provides you the right to request a re-examination of your case under its 
review procedure. How to do this is set out in the attached Appeals Notice.  Having 
followed the full procedure, if you are still dissatisfied, then you have the right to direct 
your comments to the Information Commissioner who will give your case 
consideration.
