Memorandum of Understanding on the pursuit of agreements on judicial co-operation between
the Great Socialist People’s Libyan Arab Jamahiriya and the Government of United Kingdom of
Great Britain and Northern Ireland
Confirming the friendship and strong ties between the Great Socialist People’s Libyan Arab
Jamahiriya and the United Kingdom of Great Britain and Northern Ireland;
Noting the desire of both sides to strengthen judicial co-operation, in the context of our increasing
joint efforts in the field of justice and home affairs, and specifically of our recently enhanced co-
operation on counter-terrorism;
The participants have reached an understanding that they will shortly commence negotiations on
the following matters:
- Mutual legal assistance in the field of criminal law
- Mutual legal assistance in the field of civil and commercial law
- Extradition, and
- Prisoner Transfer
The two sides will work to conclude the negotiations and prepare these agreements in their final
form; in the case of the last-mentioned agreement, working on the basis of the British model
agreement on Prisoner Transfer presented recently to the Secretary for Justice during his visit to the
United Kingdom of 22-24 May – to be signed within a period not exceeding twelve months from the
date of signing this MoU.
The UK Government will seek to obtain the agreement of all three jurisdictions within the United
Kingdom in each of those cases.
Signed at Sirte on Tuesday 29 May 2007: the two original texts, in Arabic and English, have equal
legal validity.

As for PTA, as […] says the comments on judicial agreements are still with the Libyans for comment.
They may be finalised in the near future if the Libyans have only a few minor comments to make that
can easily be resolved. However, if their suggested changes are significant then obviously this will
delay the process of completion. Once we get the suggested changes/comments back from Libya we
will be better placed to gauge when we would be in a position to sign.
In preparation for the conclusion of PTA I had a meeting with […] at the Scotland Office today. […] is
going to draft some press lines for PTA over the next week for comments so that when we have a
date for signature we already have the lines ready to disseminate to press offices. […]. I will contact
[…] tomorrow to confirm. Should there be no line on the question “when will the judicial agreements
be signed?” I would suggest a line along the lines of:

Negotiations on the judicial agreements are ongoing. Once the agreements are finalised we
will set a date for signature.

FCO have lines on the US/Libya agreement, and the PTA. The latter is one of the wider set of issues
with Libya, and we’re still waiting for their translation/comments on the drafts – so I don’t think the
timing of signature can be given at this point.

We discussed when we spoke the possibility of signature on 9th October. While we will do everything
that we can to meet this target it is not simply a question of agreeing the texts with the Libyans on
Monday. The text will have to be cleared by Ministers here and by Scotland and Northern Ireland.
Given the sensitivities surrounding the PTA the 9th is a very tight target.
