Freedom of Information (FOI) Act 2000: Request for information

Thank you for your request for information, relating to FOI/4320/KR. You have requested the following information:

Regarding this lease of council (and therefore public) property:

  1. What process have Westminster been through to ensure the best net return on the lease?

  1. What other companies were assessed along with Overix 2 Limited and Overix 3 Limited.

  1. Did Westminster carry out any Due Diligence checks on these companies in order to ensure the leases will comply with Westminster standards for the public and residents?

  1. Were the lease offers subject to OJEC/OJEU.

In response to your request I can advise you of the following:

  1. Westminster City Council (WCC) engaged their retained estate surveyors and legal advisors, to advise them on the proposed short-term lettings, in comparisons to other transactions involving the car parks and the net operational profits of the operations.

  1. Approaches were received from other operator companies in addition to Overix 2 & 3 Ltd.

I am unable to provide full details on these other companies, at this present time, and it may not be possible to disclose this data due to commercial sensitivity. I am, however, in the process of determining this, and will aim to respond to you in full, at the above electronic address, within 5 working days from the date of this letter.

  1. Yes, this is a necessary procedure.

  1. I can confirm that the lease offers were not subject to OJEC/OJEU as it was not mandatory.
