Section 43 (2)

43(2) Information is exempt information if its disclosure under this Act would, or would be likely to, prejudice the commercial interests of any person (including the public authority holding it).

Factors for withholding

  • The release of the information requested would inform the public of a business transaction between the Vehicle and Operator Services Agency (VOSA) and Tesco.

  • The release of this information into the public domain would give other businesses an unfair knowledge of their competitors.

  • Releasing details of any financial agreements reached would prejudice the interest of both parties involved.

Reasons why public interest favours withholding information

  • The information requested is considered to be commercially sensitive and would be likely to prejudice the commercial interests of both VOSA and Tesco.
