Freedom of Information (Scotland) Act 2002 – Review Outcome
I write with regard to your request for a review of the University’s response to your
Freedom of Information request (Our Ref FOI Review 2009/166-F0072674). Your
areas of concern relate to our response to your FOI request 2009/145 – F0068743 of
26 August 2009 timed 1224 hours. Specifically you have asked us to review our
responses to:
“who authorised the expenditure?” and
“was this level of expenditure (ie £293,982) planned prior to the due diligence
phase?”
The University has reviewed these responses and has concluded that they are
correct. With respect to approval of the expenditure, the University’s Senior
Management Group (SMG) approved a budget of £653.6k for Phase I of the Student
Lifecycle Project: Phase I encompassed that part of the project prior to the contract
with the supplier being signed i.e. including the due diligence. The level of spend is
clearly within the budget allocated.
The supply of documents under the terms of the Freedom of Information (Scotland)
Act 2002 does not give the applicant or whoever receives the information any right to
re-use it in such a way that might infringe the Copyright, Designs and Patents Act
1988 (for example, by making multiple copies, publishing or otherwise distributing the
information to other individuals and the public). The Freedom of Information
(Scotland) Act 2002 (Consequential Modifications) Order 2004 ensured that Section
50 of the Copyright, Designs and Patents Act 1988 (“CDPA”) applies to the Freedom
of Information (Scotland) Act 2002 (“FOISA”).
