Dear Mr Hare

Re: Request for Internal Review - Request 4250

Thank you for your dated 2nd October 2009 in which you expressed dissatisfaction regarding the response to your recent request to the Council (our ref: 4250) for the following reason:

I am sorry that you are dissatisfied with our handling of your requests and I have investigated your complaints under Stage 1 of the Council's Corporate Complaints Procedure. Further details of our procedure can be found on our website: http://www.westminster.gov.uk/services/councilgovernmentanddemocracy/councils/contactsconsultationandfeedback/complaints-and-compliments/complaints/

Response

The Council received your original request on the 17th August and responded on the 24th August. You then sent an email on the 28th August to revise your question. You sent a further email on the 2nd October 2009 as you had not received a response to your revised request. The Council acknowledged receipt of your email on the 21st October, and then sent a further email on the 29th October to inform you that your query was still being investigated.

Your email of the 28th August revised your request as follows:

1)Please supply a break down of how many complaints and/or written questions Councillor Danny Chalkley has received from MP's regarding the introduction of the motorcycle parking tax since it's introduction in Aug 2008?

2)Please provide names and dates of each MP's letter

The above questions should have been logged, and processed, as a new request under the Freedom of Information Act 2000. Unfortunately, the email appears to have been sent to a generic parking email address and was then overlooked as an FOI request.

Your complaint is, therefore upheld.

Please accept our apologies for this oversight, and for the delay for acknowledging your email of the 2nd October 2009. We continue to monitor and review our procedures in order to ensure compliance with the requirements of the Freedom of Information Act 2000.

I can also provide the following information in response to your revised request: Councillor Chalkley has received no complaints, and two written questions from two MPS regarding motorcycle parking since August 2008 as follows:

Theresa Villiers MP - 7th Jan 2009

Eric Pickles MP - 5th Jan 2009

This completes the internal review into the handling of your Request under the Council's complaints procedure. Should you be dissatisfied with our response, you are entitled to contact the Information Commissioner under Section 50 of the Freedom of Information Act.
