Thank you for your request for information, dated 14 August 2009, relating to FOI/4292 In which you state:

Can you please let me know if Westminster council gets any compensation from Verrus when the system is down as has happened a couple of days ago?

Will Westminster council be paid any compensation for loss of income? If it has, how often has this happened and how much did Verrus or any insurance pay back for loss of income since the introduction of the pay by phone service due to failure of the system?

In response to your request I can advise you of the following:

The terms of the contract do not provide for the recovery of lost income during a period system downtime.
