I write in connection with your request for information dated, which was received by Lincolnshire Police on 13 August 2009. I note you seek access to the following information:
An unmarked vehicle operated in Tealby in June 2008 manned by a Lincs Police WPC named Parker allegedly gathering ASB ' evidence against an innocent pensioner.
How many cases of covert surveillance have been carried out by your force both authorised and unauthorised by RIP Act.
How many cases of private telephone monitoring have taken place and how many cases of email monitoring.
What items of surveillance equipment are held by your force and what 'procedures' are in place before use is authorised.
May I remind you that my last reasonable request was made some seven months ago and still there have been no satisfactory answers
The FOI Act obliges us to respond to requests promptly and in any case no later than 20 working days after receiving your request. However, when a qualified exemption applies to the information and the public interest test is engaged, the Act [section 17(1)] allows the time for response to be longer than 20 working days, and a full response must be provided within such time as is reasonable in all circumstances of the case.
We do, of course, aim to make all decisions within 20 working days, including in cases where we need to consider where the public interest lies in respect of a request for exempt information.
Lincolnshire Police requires more time to consider the public interest involved in this matter. No decisions have yet been reached.
I am considering the public interest in respect of the following exemptions; however, this is not necessarily a complete list of exemptions that may be considered;
Section 23 - information supplied by, or concerning, certain security bodies
Section 24 - national security
Section 30 - investigations and proceedings conducted by public authorities
Section 31 - law enforcement
I now advise you that the amended date for a response is 28 September 2009.
I can assure you that every effort will be made to ensure an appropriate response will be made within this new timescale.
