FREEDOM OF INFORMATION (SCOTLAND) ACT 2002 
REQUEST FOR INFORMATION 
 
I refer to your request for information dated 1 February 2008 in relation to officers of this force 
who were convicted of drink driving offences.  As  you  are  aware, this request  has  been the 
subject of an investigation by the Scottish Information Commissioner for some time. 
 
In  light  of  the  decision  notice  065/2009  issued  by  the  Commissioner,  I  write  to  confirm  the 
remainder of the information requested from the force and accordingly can confirm that during 
the  period  1  January  2002  to  1  February  2008,  2  officers  were  reported  to  the  Procurator 
Fiscal and subsequently convicted for contravention of Section 5 of the Road Traffic Act 1988.  
Following  associated  misconduct  hearings  in  terms  of  the  Police  (Conduct)  (Scotland) 
Regulations 1996; both officers were required to resign.
